This CCPA Notice at Collection (“Notice”) applies to residents of the State of California relating to the California Consumer Privacy Act of 2018, as amended (the “CCPA”). As used in this Notice, “Cherry Bekaert,” “the Firm,” “we” or “us” or “our” means Cherry Bekaert LLP and Cherry Bekaert Advisory LLC. This Notice describes the categories of your “personal information” or “personal data” as defined under applicable law (collectively, “personal information”) collected by us and the purposes for which such personal information may be collected and used.  For additional information about our data privacy practices, please review our Privacy Policy.

Categories of Personal Information Collected

Identifiers and Contact Information

This category includes names, addresses, telephone numbers, mobile numbers, email addresses, signatures, account names, dates of birth, bank account information, and other similar contact information and identifiers.

Protected Classification Information

This category includes characteristics of protected classifications under applicable federal and state law.

Commercial Information

This category includes, without limitation, products and services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.

Education Information

This category includes, without limitation, information that is not publicly available personally identifiable information as defined in the Family Educational Rights and Privacy Act (20 U.S.C. section 1232g, Sec. 1232g; 34 C.F.R. Part 99).

Internet or Other Electronic Network Activity Information

This category includes, without limitation, browsing history, search history, or a consumer’s interactions with a website, application, or advertisement.

Geolocation Data

This category includes, without limitation, location information when using one of our apps, devices, or vehicles.

Audio, Electronic, Visual, Thermal, Olfactory, or Similar Information

This category includes, for example, information collected from voicemail messages, while speaking with one of our service representatives, and/or by video camera.

Biometric Information

This category includes, without limitation, fingerprints, voiceprints, hand geometry, and face geometry.

Genetic Information

This category includes, without limitation, data concerning DNA, RNA, chromosomes, or genes.

Professional and Employment-Related Information

This category includes, without limitation, information regarding job applications, information related to onboarding for payroll and benefits, and information needed for evaluating performance.

Sensitive Personal Information

This category includes:

  • social security, driver’s license, state identification card, or passport number;
  • log-in, financial account, debit card, or credit card number, in combination with any required security or access code, password, or credentials allowing access to an account; 
  • precise geolocation;
  • racial or ethnic origin, citizenship or immigration status, religious or philosophical beliefs, or union membership;
  • content of mail, email, and text messages, unless we are the intended recipient of the communication;
  • genetic data;
  • biometric information;
  • health information; 
  • data related to individuals known to be under 16 years old;
  • information regarding sex life or sexual orientation.

Consumer Profile

This category includes information drawn from any of the categories above to create a profile about a consumer reflecting the consumer’s preferences, characteristics, and behaviors.

Purposes for Which Personal Information, Including Sensitive Personal Information, Is Used

In general, we will use the personal information we collect only for the purposes it was collected, for compatible purposes, as permitted or required by law, as necessary to carry out our contractual duties and obligations, and as otherwise provided in this Notice.  For example, we may use your personal information in the following ways:

To Operate the Site.

We may use your personal information to enable use of the Site (as defined in our Privacy Policy), provide you with information or services, or to administer the Site.

For Internal Use.

We may use your personal information to: operate our business, including to provide you products or services or in connection with your application for or employment with us; review, improve, and monitor our website, applications, online services, and overall client experience; provide customization to meet specific needs; assess trends, interests, and demands of clients, applicants, and employees; and carry out our obligations and enforce our rights, including those arising from any contracts entered into between you and us, including for billing, payment, and collections.

To Communicate with You.

We may use your personal information to communicate with you, including sending messages about the availability of the Site, security, or other product or service-related issues. You may change your communication preferences at any time. Please be aware that you cannot opt-out of receiving service messages from us, including security and legal notices. We may also send you administrative or account-related information to keep you updated about your account and the Site. Such communications may include information about Notice updates, confirmations of your account actions or transactions, security updates or tips, or other relevant transaction-related information. Site-related communications are not promotional in nature.

To Provide Customer Support.

We may use your personal information to provide customer service and engage in quality control activities concerning our products and services.

To Enforce Compliance with Our Terms and Agreements or Policies.

To ensure compliance with our Terms of Use and Privacy Policy, we may process your personal information in connection with monitoring, investigating, preventing, and mitigating prohibited, illicit or illegal activities on the Site. We may also process your personal information to: investigate, prevent or mitigate violations of our internal terms, agreements or policies; enforce our agreements with third parties and business partners; and for other purposes related to the services we provide to you or your application for or employment with us.

To Ensure the Security of the Services.

We may process your personal information as necessary or appropriate to protect the rights, property, security, and safety of our employees, applicants, and clients, our information systems, and the public. Keeping you safe requires us to process your personal information, such as your device information, activity information, and other relevant information. We use such information to combat spam, malware, malicious activities or security risks; improve and enforce our security measures; and to monitor and verify your identity so that unauthorized users do not gain access to your information.

To Maintain Legal and Regulatory Compliance.

Our business is subject to certain laws and regulations which may require us to process your personal information. We may also use your personal information to respond to law enforcement requests, as required by applicable law, court order, or governmental regulations, and for other lawful processes or public safety purposes.

To Engage in Marketing Activities.

We may process your contact information or information about your interactions with us to send you marketing communications and keep you updated about the Site and our business; provide you with information about events or other materials; and deliver targeted marketing to you.

Other Purposes.

We may use your personal information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us is among the assets transferred.

We do not disclose your personal information to any third-party advertisers for their advertising purposes.

Retention.  

We retain your personal information for as long as necessary to provide you services and elected benefits and in accordance with our data retention schedule. We may retain your personal information for longer if it is necessary to comply with our legal or reporting obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, enforce our legal agreements and policies, address other legitimate business needs, or as permitted or required by applicable law. We may also retain your personal information in a deidentified or aggregated form so that it can no longer be associated with you. To determine the appropriate retention period for your personal information, we consider various factors, such as the amount, nature, and sensitivity of your information; the potential risk of unauthorized access, use or disclosure; the purposes for which we collect or process your personal information; and applicable legal requirements.

Disclosure.  

To carry out the purposes outlined above, we may disclose personal information to service providers or other third parties, such as background check vendors, third-party staffing vendors, information technology vendors, outside legal counsel, and state or federal governmental agencies.  We engage in common marketing and advertising practices to provide more relevant content and ads to users of our websites and services. Certain of these practices may involve the “selling” or “sharing” of personal information, as those terms are defined in the CCPA, or the use of such information for “targeted advertising” or “profiling,” as those terms are defined under applicable law. We do not sell personal information under the more commonly understood meaning of that word - i.e., providing personal information to third parties in exchange for money. Nor do we have actual knowledge of selling or sharing personal information of minors under the age of 16.
